Keppel Corp subsidiaries face $59.3m civil claim over AU solar farm development

The applicants claimed up to $59.3m against the Respondents under allegations of breaching an agreement

Sunshine Energy Australia and Australia Energy Group commenced a civil lawsuit against three Keppel Corporation subsidiaries in the Federal Court of Australia regarding their involvement in a solar farm development in Queensland, Australia.

The civil action lawsuit named Keppel Renewable Energy, KRE Anchorage, and Keppel Renewable Energy Australia as its respondents, along with Anthony John Youssef and Harlin Solar.

The applicants claimed up to $59.3m (AU$66.5m) against the respondents under various causes of action, alleging the Keppel Renewable Energy subsidiaries breached a Mutual Confidentiality Agreement when they developed, constructed, and operated the Harlin Solar Farm.

They also said that Keppel Renewable Energy Australia entered an agreement with Harlin Solar regarding the solar farm development, and the Respondents benefitted from it to their detriment.

In a previous announcement dated 22 December 2020, Keppel Corporation said that KRE Anchorage acquired 45% of the ordinary shares in Harlin Solar's capital. KRE Anchorage oversaw the construction and operation of the solar farm.

Keppel Renewable Energy subsidiaries denied the allegations and will defend the claim, whilst Keppel Corporation would not expect the lawsuit to impact its operations and overall financial performance.
